§ 10-77. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Automobile graveyard shall mean any establishment or place of business which is maintained, used or operated for storing, keeping, buying or selling wrecked, scrapped, ruined or dismantled motor vehicles or motor vehicle parts. Any establishment or place of business upon which six or more unlicensed, used motor vehicles which cannot be operated under their own power are kept or stored for a period of 15 days or more shall be deemed to be an "automobile graveyard" within the meaning of this article.

    Junk shall mean old or scrap copper, brass, rope, rags, batteries, paper, trash, rubber, debris, waste or junked, dismantled or wrecked automobiles, or parts thereof, iron, steel and other old or scrapped ferrous or nonferrous material.

    Junkyard shall mean an establishment or place of business which is maintained, operated or used for storing, keeping, buying or selling junk, or for maintenance or operation of an automobile graveyard. Provided, that the terms shall not include the county sanitary landfill located on Hibbs Road, Newport Township, Carteret County, North Carolina, or as hereafter relocated by the board of county commissioners. An establishment or place of business which stores or keeps for a period of 15 days or more materials within the meaning of junk which has been derived or created as a result of industrial activity shall be deemed to be a junkyard within the meaning of this article.

    Public streets, roads or highways shall mean that portion of the secondary road system of the state department of transportation located within the county together with all other streets, roads or highways within the county which have been dedicated to public use by the recording of a map or plat dedicating such road to public use, or which road, street or highway and easement, right-of-way or other written document has been recorded which permits or allows the general public as a matter of right to travel upon such street, road or highway. Provided, that interstate roads, interstate systems, primary roads and primary systems as defined in G.S. 136-143, and as designated by the state department of transportation shall not be included within the definition of the term herein.

    Visible shall mean capable of being seen without visual aid by a person of normal visual acuity.
