Article III. PROCEDURES FOR PLAT APPROVAL |
§ 3-3. Duties of the planning director, subdivision administrator, technical review committee, and planning commission and appeals of their decisions.
The Planning Director (or designee) shall be the Subdivision Administrator, also known as the administrator.
The administrator shall approve, approve with conditions, or disapprove all exempt plats; all minor subdivision plats; and all major subdivisions that involve no new right-of-way, no street construction, and no utility extensions. Any decision by the administrator to approve with conditions or to disapprove shall be in writing. In addition, the administrator shall enforce all provisions of this appendix, including those that do not involve a plat, such as Section 4-3.1. Minimum lot dimensional requirements for the unzoned areas of Carteret County. Any person or persons aggrieved by a decision of the administrator may appeal the decision to the Zoning Board of Adjustment within 30 (thirty) days of the decision. Any person or persons aggrieved by a decision of the board may appeal the decision of the Board of Adjustment to the superior court of North Carolina within 30 (thirty) days after a written and signed copy of the decision is filed in the planning department. Any aggrieved party may submit a written request for the decision at the time of the hearing.
The Planning Commission shall approve, approve with conditions, or disapprove all major subdivisions (except for those that involve no street construction and no utility extensions). Any person or persons aggrieved by a decision of the Planning Commission may appeal the decision to the Zoning Board of Adjustment within thirty (30) days after the decision is journalized in the adopted minutes of the Planning Commission. Any person or persons aggrieved by a decision of the board may appeal the decision of the Board of Adjustment to the superior court of North Carolina within 30 (thirty) days after a written and signed copy of the decision is filed in the planning department. Any aggrieved party may submit a written request for the decision at the time of the hearing.
All decisions of the administrator and Planning Commission shall be based upon the provisions of this appendix and shall follow any required review by the technical review committee (TRC). However, the TRC shall review only major subdivisions.
