Appendix A. MANUFACTURED HOMES, MANUFACTURED HOME PARKS, AND RECREATIONAL VEHICLE PARKS |
Article VII. NON-CONFORMING MANUFACTURED HOMES, RECREATIONAL VEHICLES, AND MH/RV PARKS |
1.1. Continuation of non-conforming uses and/or structures: Any MH, RV, and/or MH/RV park that is made non-conforming as a result of this ordinance or otherwise may continue as a non-conforming use. Any change in the number, size, or other physical characteristics of any MH or RV park lots and/or spaces shall be considered a change that must meet the current ordinance. 1.2. Reserved 1.3. Abandonment of a non-conforming MH/RV park: 1.3.1. If any non-conforming MH, RV, and/or MH/RV park is abandoned for a period of 180 days, the land and/or structure must thereafter be used in conformity with all existing ordinances. 1.3.2. Any MH, RV, and/or MH/RV park in or on which a non-conforming use and/or structure is superseded by a permitted and conforming use and/or structure shall not thereafter be used for any non-conforming use and/or structure. When a non-conforming use of land is ceased, such use shall not be resumed. 1.4. Replacement of a MH/RV in non-conforming parks: Owners of MH/RV's that are made non-conforming as a result of this ordinance or that are non-conforming because they are not allowed by the zoning district in which they are located, and/or are located in MH/RV parks that are made non-conforming as a result of this ordinance may replace or move their MH/RV, provided that the MH/RV that is replaced or moved meets the following setback requirements. 1.4.1. Front yard setback: Seven feet. 1.4.2. Rear yard setback: Seven feet. 1.4.3. Side yard setback: Seven feet. 1.5. Permit for non-conforming park destroyed by fire or other "Acts of God": For any MH/RV park whose value or number of spaces are destroyed by more than 50 percent as a result of fire, wind, flood, or other "acts of God", permits to rebuild or repair must be obtained within six months of the destruction or else the park will have to be rebuilt under the then current ordinance. 1.6. Projects under construction prior to non-conforming use status: No provision of this ordinance shall be construed to require a change in plans, construction, or designated use of a park, manufactured home, RV, or building in which actual construction or placement activities as a result of acquisition of a building permit were lawfully begun prior to the effective date of this ordinance. 1.7. Necessary repairs permitted: Nothing in this ordinance shall prevent the strengthening or restoration of a safe and lawful condition of any park, manufactured home, RV, or building declared unsafe or unlawful by a duly-authorized county official. |
