§ 12-1. Fishing from bridges prohibited.
(a)
It shall be unlawful for any person to at any time fish from the following bridges located in Carteret County, North Carolina:
(1)
Broad Creek Bridge spanning the waters of Broad Creek on North Carolina Highway #24.
(2)
D. Cameron Langston Bridge spanning Bogue Sound between Emerald Isle and Cape Carteret, Carteret County, North Carolina.
(3)
Deep Creek Bridge spanning Deep Creek on secondary road in Newport Township, Carteret County, North Carolina.
(4)
Gales Creek Bridge spanning the waters of Gales Creek on North Carolina Highway #24.
(5)
Harkers Island Bridge spanning the waters of the Straits.
(b)
For the purposes of this section, the word "fishing" shall be defined to include hooking lines, spears, gigs, seines or any other type or manner of fishing in order to catch any fish within the waters lying along or under the above named bridges.
(c)
Any federal, state or county law enforcement officer is authorized to enforce this section.
(d)
Any person violating the terms of this section shall be subject to those penalties as set forth in section 1-6 of this Code.
(e)
The clerk of the board of county commissioners is hereby directed to send a certified copy of the same to the state highway commission pursuant to the provisions of G.S. 136-102.5 and request such agency to erect "NO FISHING" signs on such bridges. The failure of the highway commission to erect such signs shall in no way invalidate the provisions of this section.
