§ 10-91. Harkers Island Harbor of Refuge regulations.

  • (a)

    Definition. For purposes of this section, the "Harkers Island Harbor of Refuge" refers to that tract of land on Harkers Island upon which the county has developed docks, piers, and a bulkhead and a parking lot. This area is posted with signs designating the same as the Harkers Island Harbor of Refuge.

    (b)

    Purpose. The county has developed, on the northeast end of the bulkhead a public access area for both commercial and recreational uses including but not limited to loading and unloading passengers, equipment and seafood. This area is posted with signs designating the same as a public access area.

    (c)

    Use of area regulated.

    (1)

    No person shall leave any vehicle, boat trailer or other obstruction in the access area in such a location, position or condition that it will prevent, impede, or inconvenience the use by other persons of any facility constructed for the purpose of mooring boats. No person shall leave parked any vehicle, boat, boat trailer or other object at any place in the access area other than on such place or zone as is designated as an authorized parking zone and posted or marked as such.

    (2)

    No person shall moor a vessel or any type of watercraft at the public access area of the bulkhead for more than two hours, it being the purpose of this paragraph to allow temporary moorage only for the purpose of loading or unloading gear, equipment or seafood, or fueling or taking on passengers.

    (3)

    No person shall possess a loaded firearm in the access area. No person shall operate a vehicle in the access area in a manner so as to endanger life or property.

    (4)

    No person, when using the access area, shall deposit any debris or refuse anywhere on the grounds of the area. No person, when using the access area, shall do any act which is prohibited or neglect to do any act which is required by signs or markings placed on such area under authority of this section for the purpose of regulating the use of the area. At any time when all designated parking zones in the access area are fully occupied, any person may enter and use such facilities, provided such person makes other arrangements for parking and violates none of the provisions of this section or signs or markings made or posted pursuant hereto.

    (5)

    It shall be a violation of this section to use the access area for any purpose other than as specified in subsections (c)(1), (c)(2) and (c)(4).

    (6)

    A violation of this section shall constitute a Class 3 misdemeanor punishable by a $50.00 fine for the first violation, a $250.00 fine for the second violation, a $500.00 fine for the third violation and imprisonment for a period not to exceed 30 days.
