§ 1-6. Conflict and separability.

  • This ordinance is not intended to interfere with, annul or abrogate any other ordinance, rule or regulation, statute or other provision of law applicable to Carteret County. Where any provisions of this ordinance impose limitations different from those imposed by any other provision of this ordinance or any other ordinance, rule or regulation, or other provision or law, whichever provisions are more restrictive or impose higher standards shall control.

    This ordinance is not intended to abrogate any easement, covenant, or any other private agreement or restriction, provided that where the provisions of this document are more restrictive or impose higher standards or regulations than such easement, covenant, or other private agreement or restriction, the requirements of this ordinance shall govern. Where the private provisions impose more restrictive or higher standards than this ordinance than such private provisions shall be operative and supplemental to these regulations.

    If any part or provision of these regulations or application thereof to any person or circumstances is held invalid by any court of competent jurisdiction, such judgement shall be confined in its operation to the part, provision or application directly involved in all controversy in which such judgement shall have been rendered. Such judgement shall not affect or impair the validity of the remainder of this ordinance even without any such part, provision, or application.
