Appendix B. SUBDIVISION REGULATIONS |
Article I. GENERAL PROVISIONS |
§ 1-4. Jurisdiction.
The regulations contained herein, as provided in G.S. 153A-320, shall govern each subdivision of land within Carteret County except those lands lying within the jurisdiction of any municipality, unless such municipality formally requests the county to enforce these regulations within the municipality's area of jurisdiction. Any municipal governing body may, upon a 30-day written notice, withdraw its approval of the county subdivision regulations and such ordinance shall have no further effect within the municipality's jurisdiction.
In accordance with the provisions of G.S. 153A-355, the following types of subdivisions are not subject to the regulations established herein:
(1)
The combination or recombination of portions of previously platted lots where the total number of lots is not increased and the resultant lots are equal to or exceed the standards of the county as delineated in this subdivision ordinance;
(2)
The division of land into parcels greater than ten acres where no street right-of-way dedication is involved;
(3)
The public acquisition by purchase of strips of land for the widening or opening of streets; and
(4)
The division of a tract in single ownership, the entire area of which is no greater than two acres, into not more than three lots where no street right-of-way dedication is involved and where the resultant lots are equal to or exceed the standards of the county as delineated in this subdivision ordinance.
